Last August, Apple sued a small company called Prepear because its pear-shaped logo looked a lot like the Apple logo. As far as I know a pear doesn’t look very much like an apple, moreover, Prepear is unrelated to the tech world, so base its claim on it may confuse the user (argument that Apple usually used in these cases), had a very short route.
It appears that Apple’s law firm knowledge entered into him, and as can be read in MacRumors, called for the lawsuit to be paralyzed for the next 30 days in an attempt to reach a deal with Prepear, so that if they don’t come to an agreement by January 23, the legal dispute between the two companies will resume.
But what is Prepear?
Prepear is a very small company, with only 5 employees, which offers healthy recipes and a shopping list through the same mobile app. When Apple reported, the company was forced to fire some of its employees to face the lawsuit that can cost it several thousand dollars in lawyers alone.
This isn’t the first time those in Cupertino have sued a company for using a logo that Apple says may confuse the user, a position that is expected to change, according to Prepear, stating that:
It’s a very scary experience to be legally attacked by one of the biggest companies in the world, even though we clearly haven’t done anything wrong, and we understand why most companies give up and change their logos.
We are defending ourselves against Apple not only to maintain our logo, but also to send a message to big tech companies that small business bullying has consequences.
