Phoenix Digital has lost out against Bungie in the legal battle over Destiny cheats.
There have been many legal disputes over cheats and copyright infringement, but this time things went a little differently. First, Bungie took action against Phoenix Digital over cheats, which the company did not want to accept. Phoenix Digital argued that Bungie had failed to provide evidence of copyright infringement and filed suit.
Meanwhile, Stephen Tolito that this may be the first case in the world in which the plaintiff has won in such a case.
After Phoenix Digital filed suit, the case went to a jury, which had to decide whether Bungie’s copyrights had been infringed by Phoenix Digital providing cheats for Destiny 2.
The jury was clearly on Bungie’s side, and while the $63,000 award may not be huge, it is still a significant decision that could set a precedent for the industry.
In his report, Tolito published a statement from Bungie’s lawyers, who said they were grateful for the diligence, professionalism and concern of the judge, his staff and the jury. They were committed to the players and wanted to continue to protect them from cheating, even if that meant taking this and future cases to court.
Since more and more companies have taken action against providers of cheats in recent months, things are likely to get quite exciting in this regard in the near future.
