Apple is now in the crosshairs of Spanish authorities for possible anti-competitive practices linked to the App Store
There National Commission for Markets and Competition (CNMC) has just published a new press release in which calls for direct investigation into Apple for “possible anticompetitive practices” related to the App StoreThis would constitute an infringement due to a “prohibited abuse of a dominant position”, according to Article 2 of the Law on the Protection of Competition and Article 102 of the Treaty on the Functioning of European Law. As if that were not enough given the already delicate situation with the EU, USA now joins one of the countries investigating Apple for anti-competitive practices. Let us recall that a few months ago, the United States also spoke out on this fact, which has degenerated even to the Ministry of Justice of the North American country.
According to the press release, Apple engages in “ongoing anticompetitive practices” which, in turn, impose “unfair commercial conditions” on all Spanish developers who use the App Store as a means of distributing their applications. The CNMC specifies that this investigation began automatically because the economic activity linked to application stores has acquired a certain importance.
Apple could be sanctioned in the same way that the EU has considered in similar situations. In this case, The fine would amount to 10% of Apple’s global business volume.specifying that the amount would correspond to the previous year (2023).
The investigation could take several months, or even years.
