“I did not ask for a business contact”
As we’ve said before, companies often use techniques to get our approval to receive marketing information, whether it’s via email, text message, phone calls, or all three. If you’re really sure you didn’t ask for it, you have every right to ask for it.
It’s been over a year since a new rule came into effect to prevent unwanted sales calls. It’s called a new article in the General Telecommunications Law which prevents a company from establishing this type of contact with us if we do not request it in advance. Of course, there are some exceptions such as those of telephone operators and their “authorization” to continue calling six months after termination.
In any case, we insist. If you did not actually request this contact and it does not fall under the exception, you must clearly express your opposition to this call and thus show that the company is committing an illegality.
“It is illegal for you to contact me at this time.”

There are also two legal calendars. On the one hand, the one that reflects the aforementioned law and that binds all Spanish companies. On the other hand, the calendar of the telephone companies, which signed an agreement two years ago, is intended to be even stricter.
- General schedule: Monday to Friday (except public holidays) from 9:00 a.m. to 9:00 p.m.
- Telephone company opening hours: Monday to Friday (except public holidays) from 10:00 a.m. to 3:00 p.m. and from 4:00 p.m. to 9:00 p.m.
Therefore, any call made outside of these hours can be considered illegal, so you have every right to complain and say this phrase so that the company becomes aware of it and stops the call.
“Remove my number from your database”
It’s a sentence you can always say, whether or not you have already requested contact (whether by mistake or not). It is your right to be able to opt out of this type of communication and you only need to request it during the call itself, although in some companies there is another way to do it.
In any case, if you had to send an email or call another number, companies are required to provide you with the steps to do so. If you have to make another call, that number will also be free. Ultimately, whatever the procedure, They will be obliged to respond to your request. and you will no longer receive calls from this company.
What if they don’t react to these sentences?
In a perfect world, just one of those sentences would be enough to stop receiving sales calls. However, they can call you back from that same company. And while this may be due to an error in their systems, it is beyond you and even more so when you have rejected these communications. So, is it possible to claim and, definitively, call into question the illegality of the company.
If they call you outside of established hours and that we have previously highlighted, you can exercise your right to complain to the AEPD (Spanish Data Protection Agency) through its website. On the other hand, if they do not answer unsolicited calls According to the new regulations, it is also possible to make a complaint via the AEPD or, failing that, via an OCU (Organisation of Consumers and Users) form.
It should also be remembered that It could be a fraudulent identity theft in order to scam you. If this practice itself is illegal, you will already understand that scammers are also indifferent to breaking laws such as schedules and the rest. In these, there are other keys to identify them.
