During the course of our investigation, we also became aware of several other online actors who apparently played a role in the pirate shops. However, we were unable to determine the identities of the locations of these other actors with sufficient certainty to identify them in the original complaint. NOA therefore did not include these individuals in the lawsuit…in the expectation that ordinary discovery…would reveal the identity and location of these actors.
However, since Williams allegedly evaded Nintendo's attempt to serve him and then failed to appear in court, Nintendo argues in its filing that this means they could not find these identities through discovery and is therefore requesting the subpoenas. The company is currently worth 67 billion dollarssays these will be “limited in scope” and will aim to “identify the account holders and sources of all payments made and, where appropriate, compile aggregated traffic and access statistics for Pirate Shops websites and associated online locations.”
Nintendo is asking Google for access to Google Drive and Gmail data, but is not specific about its intentions regarding Discord. The situation on Reddit is described as follows:
Reddit, Inc. operates a social media platform that allows users to post, often using pseudonyms, in various forums known as communities or “subreddits.” The defendant was a main moderator of the SwitchPirates community under the name “Archbox,” which had more than 190,000 members. Nintendo has reason to believe that other accounts active in the SwitchPirates Community may also have been controlled by Defendant or may be traceable to other individuals who worked with Defendant.
