The sentencing judge considers that what Apple is doing is a “tied sale” because there are consumers who do not have a compatible power adapter at home and they are forced to buy a new one, which is sold separately from 2020.
The decision not to include the charger in the iPhone box caused Apple to rack up 20 million reais (about $3.7 million) in fines in Brazil, not including other countries. The first time and now the company decided to appeal the decision, getting more time to continue selling the devices in Brazil
The court’s decision is not only against Apple. At the beginning of this year, Samsung received the same requirement in Brazil. But unlike the creator of the iPhone, the South Korean company has decided to comply with the Brazilian government and now includes the plug adapter with its latest products, such as Galaxy Z Flip 4 and Galaxy Z Fold 4.
The charger wouldn’t be the only thing
However, the charger requirement is not the only thing Brazil demands from Apple. The Brazilian Telecommunications Regulatory Agency, Anatel has proposed that all smartphones sold in the country adopt USB-C as a standard. The same requirement of the European Union, which will also force Apple to adopt USB-C in the iPhone from 2024.
Perhaps as in Europe, this last requirement is subject to a period of adaptation by companies, but in the case of the charger Samsung’s precedent leaves Apple little choice.
As for a long time in France Apple included EarPods headphones in the iPhone box, despite the fact that these are also not in the box since the year 2020, Apple will have to do something similar in Brazil. In other words, the box will remain the same but a charger will be added as an accessory.
