Phone spam is a problem. We see it almost daily with actions of all kinds, like being called and as soon as we answer, they hang up on us. Fortunately, even if we don’t remove them completely, there are ways to prevent these calls on Android. Besides, a new law will further regulate this aspect which was already very marked in the GDPR.
This new regulation It will come into effect on June 30.. As of the publication of this note, we are on day 15, so there are only a few weeks left before it goes into effect. The objective is clear and is that, among other things, no one can call us without permission.
Laws and telecom agreements, equivalent to the end of spam?
We can think the opposite in view of the heaviness of certain calls, but in reality are increasingly regulated. Under the general law for the defense of consumers, a timetable is established for commercial calls. In addition, in the case of telemarketers, a further step has been taken by further limiting this contact time. This is what it looks like:
- For commercial calls (in accordance with the law): Monday to Friday from 9 a.m. to 9 p.m., except public holidays.
- For commercial calls from operators (according to their agreements): Monday to Friday from 10 a.m. to 3 p.m. and from 4 p.m. to 9 p.m., except public holidays.
The problem is that not all calls come from telemarketers offering services. The time is also not the issue, just the simple fact of receiving such calls. Also, to a large extent, some of the calls we receive are scams. In these cases it is better to learn to identify them and block the numbers. And with regard to commercial calls from other companies, the law to which we referred at the beginning is clear.
This is a new paragraph of the General Telecommunications Law, which in its article number 66 states in general terms that any commercial call not requested by the consumer will be prohibited. The specific excerpt from this regulation reads as follows:
“In order to further protect the legitimate interests of consumers and users, the transmission, by the operators, of unsolicited telephone calls by the consumer and/or user for the purpose or effect of promoting or selling goods or services. The foregoing restriction will not apply as long as there is prior consent of the consumer and/or user to receive commercial communications allowing the user.”
Therefore, in accordance with all the regulations already in force and this addition, from June 30th we are supposed to receive fewer commercial calls and even none at all. We insist that “it’s meant to be”. The truth is that you may have already given your consent without knowing it. Yes, under the classic conditions that we accept without reading (the majority).
The solution will therefore be to make the companies understand our disagreement with the receipt of these calls and to ask that they are no longer sent to us in the future. It is also often interesting to subscribe to the Robinson List, to activate Google’s ‘Telephone’ filters and finally to block this type of call.
